What you are purchasing
Scalo produces video ads using artificial intelligence. You provide the product, the angle and the format; we deliver a vertical MP4 file, with captions and music, ready to run as an ad. We do not sell software or licenses: we sell finished pieces.
Payment
Payment is per ad, with no required subscription and no monthly minimum. The unit price depends on how many ads you request in the same order, according to the table published on the pricing page. The price is fixed at the time the order is confirmed: if we later change the price list, your order in progress is not affected.
Delivery
The times we publish are production times and are met under normal conditions. There may be delays due to causes beyond our control, such as an outage at a generation provider. If an order is going to take longer than promised, we will notify you before the deadline passes, not after.
When the problem is not on our side
To produce the ads, we use third-party services: video, voice and text generation providers, as well as hosting and the database. We do not control them. If any of them goes down, changes its terms, limits our access or simply stops working, production stops, and this is not something we can resolve on their side.
The same applies to power or internet outages, failures of third-party infrastructure, government measures, natural disasters and any other cause beyond our reasonable control.
For as long as such a situation lasts, delivery deadlines are suspended and do not run. We will notify you as soon as we know, and tell you what we expect and when. This is not an excuse to disappear: if we cannot tell you when it will be resolved, we will tell you that as well.
If the interruption extends beyond fifteen calendar days, you may cancel the orders that have not started, and we will return those credits to your account, at no cost and with no expiration. Orders already delivered remain as they are.
This does not cover problems on our side. If the system fails because of something we do control, the preceding sections apply.
If an ad has a defect
Work is done by campaign. Each clip goes through an automatic check as soon as it is generated, and any broken clip is discarded and redone before editing. Afterwards, a person reviews each ad before it is delivered. These checks do not replace your own review: when you receive the campaign, you review all your ads, and if we missed something, you report it from the dashboard.
Revisions and corrections
Each delivery is entitled to a revision free of charge. You may indicate all the corrections you need on the delivered ads: the team reviews them and an editor fixes each error by hand, as many times as necessary, until the ad is free of errors.
The deadline to request it is two calendar days from when you receive the delivery email. After that deadline, the delivery is deemed accepted.
Corrections are delivered within two business days following the request.
What the revision covers
Production defects attributable to Scalo: cut-off or inaudible audio, illegible or misplaced text, the product shown incorrectly, a video that is incomplete or shorter than requested, and obvious visual errors in the generation.
What it does not cover
Errors in the material submitted by the client: a script that is poorly written, incorrectly pasted, contains spelling mistakes or includes incorrect product information. The ad is produced with the text exactly as it was submitted.
Changes of judgment or preference once the ad has been produced: changing the script, the avatar, the approach or the style. The choice of avatar and script is the client's and is made before production.
The commercial performance of the ad. Scalo produces the ad; it does not guarantee sales, reach or results on any platform.
Rejection of the ad by third-party platforms (Meta, TikTok, Google or others), whose policies are beyond Scalo's control.
Credits and payments
Credits are purchased in advance and do not expire.
Credits are non-refundable and cannot be converted into money. In the event of a production defect, Scalo corrects the ad as described above; it does not refund the amount paid.
Credits are for the exclusive use of the account that purchased them and are non-transferable.
Who owns the videos
You do, without restrictions. You may use them in any advertising you wish, for as long as you wish, without a watermark and with no rights to renew. We do not resell them or use them for another client.
We reserve the right to show pieces that have already been published as examples of our work. If you prefer that we do not, let us know and we will not do so.
Who owns what you send us
By uploading product photos, text, trademarks or any other material, you confirm to us that you have the right to use them. We use them solely to produce your ads.
What we do not produce
We do not produce ads that claim medical results the product does not have, that impersonate a real person without their permission, or that promote products whose advertising is prohibited where you intend to run the ads. If an order falls into any of these cases, we will stop it and let you know.
Termination
There is no contract or minimum term. You simply stop ordering. Orders already confirmed are produced and charged; those that have not started are cancelled at no cost.
Limitation of liability
We produce the pieces; we do not guarantee advertising results, because they depend on your product, your offer and your targeting, which we do not control.
Our liability to you is limited to what you paid for the ads involved in the claim, and in no event shall it exceed the total amount you paid us in the twelve months prior to the event giving rise to the claim.
We are not liable for indirect damages: sales that were not made, profits that were not earned, campaigns that did not perform, lost opportunities, damage to reputation, or the cost of any advertising spend you invested. Nor are we liable for the rejection of an ad by a platform, as stated above.
The service relies on external providers and on artificial intelligence models that evolve and sometimes fail. We make it work and we check every clip, but we cannot promise that it will be available without interruptions or that every generation will come out perfect the first time. That is what the free revision is for.
Nothing in these terms limits what the law does not allow to be limited. If any of these limitations is not valid in your country, that part does not apply and the rest remains in effect.
Changes to these terms
These terms may change: new formats appear, a provider changes, or something that did not work in practice is adjusted. When that happens, we will publish the new version on this page with its date, and notify you by email at your account address at least thirty calendar days in advance.
Credits you have already purchased are governed by the terms you accepted when you purchased them. A new change does not apply to them retroactively. We record which version you accepted and when, so this can be verified.
If you do not agree with the new version, you simply do not purchase more credits. You may use the credits you have under the previous rules until they run out. If you prefer not to use them, write to us within thirty days of the notice and we will reach an arrangement.
Two exceptions to the advance notice: changes that only benefit you, and changes we are required to make by law or by a provider, take effect when they must, and we will notify you of them all the same.
If the company changes hands
We may transfer this agreement, together with your account, your credits and your orders in progress, if we sell the company, merge it or transfer the service to another company. Your credits retain the same value and your orders are produced in the same way. We will notify you by email when this happens.
It does not work the same way on your side: your account and your credits belong to the company or person that purchased them and may not be sold, assigned or transferred to a third party. If your company changes ownership or legal name and you wish to keep the account, write to us and we will resolve it.
How we communicate
Anything we need to tell you officially is sent by email to your account address: notices of changes to these terms, of deliveries, of problems with an order and of anything that affects the service. Keep that address up to date from your profile, because it is the only one we use.
Anything you wish to tell us officially must be sent to hola@scaloads.co, which is also where any formal claim must be submitted. The dashboard and the contact form are for day-to-day matters, but for formal matters use that email address: it is what allows us to respond with a date and keep a record for both parties.
A notice is deemed received forty-eight hours after it is sent, unless it bounces. If it bounces, we will send it again and let you know through the dashboard.
Governing law and jurisdiction
Scalo is an Argentine company and provides the service from Argentina. These terms are governed by Argentine law.
If a disagreement arises, we will first discuss it. Either party may raise it in writing to the other party's contact email, and from that day there are thirty calendar days to try to resolve it between us. Only if that fails may the matter be taken to court.
Once that period has elapsed, the dispute shall be submitted to the ordinary courts of the Judicial Department of La Matanza, Province of Buenos Aires, Argentina.
With one exception that is worth stating clearly: if you contract as a consumer and the law of your country gives you the right to bring a claim before the courts of your place of residence, that right is yours and this paragraph does not take it away. The foregoing applies when you contract for your business activity, which is the case for almost all of our clients.
